2009 National Biennial RCRA Hazardous Waste Report

The Purpose of the 2009 National Biennial RCRA Hazardous Waste Report:
The US Environmental Protection Agency's (EPA) mission to protect human health and the environment includes the responsibility to effectively manage, with the States, the nation's hazardous waste. As part of this task, the EPA and the States collect and maintain information about the generation, management, and final disposition of the nation's hazardous waste regulated by the Resource Conservation and Recovery Act (RCRA).

This data collection is done on a two-year cycle as required by Sections 3002 and 3004 of the Resource Conservation and Recovery Act (RCRA).

Sites Required To File The Hazardous Waste Report:
You are required by Federal statute (mandatory reporting) to complete and file the 2009 Hazardous Waste Report (also known as the “Biennial Report”) if your site:

  • Met the definition (see below) of a RCRA Large Quantity Generator (LQG) during 2009; And/Or
  • Treated, stored, or disposed of RCRA hazardous wastes on-site during 2009.

Definition Of A RCRA LQG Who Must Report For Calendar Year 2009
A site is a RCRA Large Quantity Generator (LQG) for 2009 if the site met any of the following criteria:
(a) The site generated, in any single calendar month, 1,000 kg (2,200 lbs) or more of RCRA non-acute hazardous waste; or
(b) The site generated, in any single calendar month, or accumulated at any time, more than 1 kg (2.2 lbs) of RCRA acute hazardous waste; or
(c) The site generated, in any single calendar month, or accumulated at any time, more than 100 kg (220 lbs) of spill cleanup material contaminated with RCRA acute hazardous waste.

NOTE: You will report your current Hazardous Waste Generator status as of the date of submitting your 2009 Hazardous Waste Report on EPA Form 8700-12, 8700-23 (revised April 2009) Site Identification Form in Item 10.A.1 - Generator of Hazardous Waste. Your status may have changed since 2009.


EPA Report Booklet: Is available through The 2009 BRS Instruction Booklet and Forms.  A hard copy of the 2009 BRS Instruction Booklet and Forms will also be mailed out week of January 18th to LQG/TSD Facilities.

Electronic Reporting: For the 2009 reporting year, there is only one reporting source available. Easitrak was chosen because it best meets electronic requirements, is user-friendly and provides facilities self-guidance throughout the process.

Deadline for 2009 BRS
The 2009 Hazardous Waste Report must be entered into EASITRAK by March 15, 2010. A hard copy of your Hazardous Waste Report with a certified original signature on the RCRA Subtitle C Site Identification EPA Form 8700-13 A/B must be mailed by no later than March 15, 2010.
